Hi-Moment is a product that is owned and operated by BLUE STAR TRADING LIMITED. 1. Eligibility & Account Creation

In order to use the Service, you must be the age of majority in your country and fully competent to understand and agree to the Terms. During the creation of your account, you must provide a valid email address and any other information requested in order to complete the signup process (Login Credentials). You are solely responsible for maintaining the security of your Login Credentials and account. You agree to protect your account by guarding your Login Credentials, and to change them as soon as possible if you believe their security has been compromised. You may not disclose your Login Credentials to any third party and are solely responsible for any use of or action taken using your Login Credentials. You also agree to notify BLUE STAR TRADING LIMITED immediately if you believe your account has been used without your authorization. BLUE STAR TRADING LIMITED cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

2. Your Responsibilities

You are responsible for all content posted and activity that occurs under your account (even when content is posted by others who have access to your account). You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

YOU EXPRESSLY UNDERSTAND AND AGREE THAT BLUE STAR TRADING LIMITED SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF BLUE STAR TRADING LIMITED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM YOUR USE OF THE SERVICE.

All product prices are listed in USD and are subject to change without prior notice. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.

4. Cancellation & Termination

You are solely responsible for properly canceling your account. An email request to [email protected] to cancel your account is acceptable as cancellation notice.

BLUE STAR TRADING LIMITED, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other BLUE STAR TRADING LIMITED service, for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your account or your access to your account, and the forfeiture and relinquishment of all content in your account. BLUE STAR TRADING LIMITED reserves the right to refuse service to anyone for any reason at any time.

5. Modification to the Service & Prices

BLUE STAR TRADING LIMITED reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

Prices of all products are subject to change upon 30 days’ notice from us. Such notice may be provided at any time by posting the changes to the site at www.hi-moment.com or via email.

BLUE STAR TRADING LIMITED shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

Your use of the Service is at your sole risk. The service is provided on an as is and as available basis.

8. No Warranties

AS SPECIFIED IN THE TERMS, THE SERVICE IS PROVIDED ON AN AS IS AND AS-AVAILABLE BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS, STATUTORY, OR IMPLIED, INCLUDING, BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY OR ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE. BLUE STAR TRADING LIMITED DOES NOT WARRANT THAT: (I) THE OPERATION OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE; (II) FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (III) THE SERVICE IS NOT VULNERABLE TO FRAUD OR UNAUTHORIZED USE; (IV) USE OF THE SERVICE WILL RESULT IN ANY SALES OR REVENUE OR OTHER BENEFIT TO YOU; OR (V) THE FEATURES, CATEGORIES, OR FUNCTIONALITIES OF THE SERVICE WILL BE AVAILABLE AT ANY TIME IN THE FUTURE.

9. Limitation of Liability

NEITHER PARTY SHALL BE LIABLE TO THE OTHER FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES, ARISING OUT OF OR RELATED TO THESE TERMS INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, AND THE LIKE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU AGREE THAT BLUE STAR TRADING LIMITED AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THE USE OF THE SITE OR THE SERVICE IS LIMITED TO THE FEES PAID TO BLUE STAR TRADING LIMITED BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE ACTION GIVING RISE TO SUCH LIABILITY.

10. Force Majeure

We will not be liable for any delay or failure to perform any of our obligations under these Terms by reasons, events, or other matters beyond our reasonable control.

11. Notices

Except as explicitly stated otherwise, legal notices shall be served on you at either the physical or email address you provide to BLUE STAR TRADING LIMITED during the registration process or on BLUE STAR TRADING LIMITED via email at [email protected].

Notice by email shall be deemed given 24 hours after the email is sent. Notice given by mail shall be deemed given three days after the date of mailing.

12. No Agency

No agency, partnership, joint venture, employer-employee, or franchiser-franchisee relationship is intended or created by the Terms. BLUE STAR TRADING LIMITED is not your agent, fiduciary, trustee, or representative.

13. Miscellaneous

These Terms and the rights and obligations hereunder are not transferable or assignable by either party without the prior written consent of the other party. No waiver or modification of these Terms shall be valid unless in writing signed by each party. If any provision of these Terms is held to be unenforceable, such provision shall be reformed only to the extent necessary to make it enforceable. These Terms contain the complete agreement between the parties with respect to the subject matter hereof, and supersedes all prior or contemporaneous agreements or understandings, whether oral or written.
